<p>There are also plenty of things that keep you up at night.</p>
<p>One of those sleep-depriving concerns is the fear of being sued. Even a modest lawsuit can rack up expensive legal bills that can severely harm a small business – perhaps force it into bankruptcy.</p>
<p>At the risk of minimizing the serious nature of a lawsuit – and pardon me for grasping for a sports metaphor, but – sometimes the best defense is a good offense.</p>
<p>Take proactive steps to help your business avoid finding it situations that can lead to lawsuits. The big headline is pretty obvious: do things right, treat people properly and try to rectify any problems swiftly.</p>
<p>Beyond that, here are a few helpful and specific things you can do to avoid lawsuits and to give yourself the tools you need to resolve lawsuits quickly should you face one.</p>
<p><strong>Document Everything</strong></p>
<p>Most legal actions that occur against small business generally concern some manner of contract or agreement dispute. The solution: take copius notes of all discussions and ensure all contracts are signed and witnessed.</p>
<p><strong>Create an Employee Handbook</strong></p>
<p>It’s difficult to hold employees accountable for their at-work actions if you have no document that establishes what their actions should and should not consist of. When you give a new employee a handbook, don’t forget tip number one: sign a document that states that your employee received and read their handbook!</p>
<p><strong>Understand Intellectual Property Laws</strong></p>
<p>Companies covet their logo, tagline and associated branding. And rightly so! Take a moment to study your logo imagery and ensure it does not violate any existing trademarks.</p>
<p>To compare your company’s logo and branding imagery with existing copyrighted material, you can do a quick <a href="http://www.uspto.gov/trademarks/index.jsp">search of the U.S. Patent and Trademark Office website.</a></p>
<p><strong>Properly Maintain your Workspace</strong></p>
<p>The likelihood of injury lawsuits from customers and employees can be dramatically reduced by taking a few common sense but vitally important steps toward maintaining your environment.</p>
<p>Keep walkways clear and free of debris, standing water or ice.</p>
<p>Ensure that storage rooms are stocked carefully to minimize spills or falls.</p>
<p>Fill parking lot potholes and keep outdoor spaces clean, safe and well-lit.</p>
<p><strong>Communicate</strong></p>
<p>Many times, the most effective tool you can employ to avoid a potential lawsuit is an open and frank conversation. A conversation regarding the issue may be uncomfortable, but it will certainly be less expensive and time-consuming than resolving a lawsuit.</p>

										<content:encoded><![CDATA[<p>In the spring of 2014, actress Gwyneth Paltrow and her rock star husband Chris Martin of the British band Coldplay announced that after just more than a decade of marriage, they were undergoing a “conscious uncoupling.”</p>
<p>Boy, that sure does sound fancy.</p>
<p>While I don’t recall ever seeing “conscious uncoupling” listed in Mississippi’s divorce laws, I suppose that if I think about what that term could mean, it’s really not that far removed from simply two parties coming to terms on a divorce agreement.</p>
<p>And that I can understand.</p>
<p>In the state of Mississippi, one party cannot be awarded a divorce hearing if the other party does not want the divorce and no cause exists. You either have to agree to the divorce or there must exist a cause such as adultery, irreconcilable differences or habitual cruelment.</p>
<p>Every divorce case that is filed in the state of Mississippi must declare the grounds in which the divorce is to be granted. The grounds for your divorce must be substantiated with evidence or with sworn testimony otherwise the court may dismiss the case.</p>
<p>When you are petitioning the court for a divorce, or agreeing to a divorce, it is vital that you completely understand the grounds and any potential legal repercussions. With my help, you’ll never be in the dark regarding your case.</p>

										<content:encoded><![CDATA[<p>You’re feeling a little cramped in your home and you’ve found an amazing Colonial across town that has a backyard to die for and plenty of rooms for the kids.</p>
<p>Time to call a real estate agent. But should you also call a real estate lawyer?</p>
<p>More often than not, the answer is no.</p>
<p>But first, allow me to offer an explanation of some of the tasks a lawyer might undertake when assisting in matters of real estate.</p>
<p>Real estate lawyers help clients with legal issues related to residential and commercial real estate, tenants and neighbors, commercial leasing, and private property ownership.</p>
<p>Lawyers assist with transfer of real estate property, including purchase and sale. They help clients to deal with the legal aspect of rental property and defend the rights of owners, landlords, renters, and tenants. Real estate lawyers specialize in land use, zoning, property development, and foreclosure.</p>
<p>Most commonly, lawyers working a real estate-related project will be tasked with drawing up or reviewing the legal documents you’ll sign to assume ownership or to lease property.</p>
<p>So, let’s readdress the question from the beginning of this article: as you prepare to make your big move into your dream home, do you need to call me or another lawyer to help you navigate the transaction?</p>
<p>The easy answer is to consult with your real estate agent. He or she will be well verse in local laws and regulations to determine whether hiring an attorney is necessary by law. If it is, your agent will be able to recommend a trusted lawyer. Even if it not necessary by law to hire a lawyer, you may consider obtaining legal advice if you can answer “yes” to more than one or two of the following questions:</p>
<p><strong>For Buyers:</strong></p>
<ul>
<li>Are you an out of town buyer?</li>
<li>Are you buying a property that is a short sale or bank owned?</li>
<li>Are you buying a property that is part of an estate sale?</li>
<li>Are you buying a commercial property?</li>
<li>Are you buying a property that could potentially have some structural issues?</li>
<li>Are you buying a property in a problematic area such as a flood zone or areas with adverse conditions (tornado prone, radon, toxicity levels, etc.)?</li>
</ul>
<p><strong>For Sellers:</strong></p>
<ul>
<li>Are you selling a property that is in some state of distress?</li>
<li>Are you the heir or executor of a property whose owner is now deceased?</li>
<li>Are you selling a house with a non-cooperative partner?</li>
<li>Do you have that gut feeling that something could possibly go wrong based on knowledge you have about the property?</li>
<li>Do you have judgments or liens in your background?</li>
</ul>

<p>But are they the right questions?</p>
<p>When you sit down for an initial consultation with a lawyer, the conversation will focus on topics related to the situation or legal action that sent you seeking advice in the first place.</p>
<p>But before you dive too deeply into the specifics of your situation, it’s a good idea to find out a little about the experience, and expertise of the lawyer you’re about to place a great deal of faith in.</p>
<p>Whether you’re planning a meeting with us here at Bosserman Law or another law firm, make the following list of questions a part of that list I mentioned above.</p>

<li><b><strong>How long have you practiced law?</strong> </b></li>
</ul>
<p>&nbsp;</p>
<p>Maybe an obvious question, but a vitally important one if your specific situation could become tricky, convoluted or otherwise out of the ordinary.</p>
<ul>
<li><b><strong>What type of cases do you generally handle? What percentage of your practice is devoted to (the practice area in question)?</strong> </b></li>
</ul>
<p>&nbsp;</p>
<p>Plenty of lawyers are well versed in multiple area of the law, but if you’ve scheduled a corporate legal matter with the lawyer who helped you write your living will, this question is important.</p>
<ul>
<li><b><strong>Other than a law degree, what kind of special training or knowledge do you have that might apply in my situation?</strong> </b></li>
</ul>
<p>Lawyers like myself have multiple opportunities to enrich our knowledge base through specialized seminars, classes and more.</p>
<ul>
<li><b><strong>What is your approach or philosophy to winning or representing a case?</strong> </b></li>
</ul>
<p>Some lawyers are content with securing out-of-court deals or agreements, while others are intent upon “going for the kill”. It is important that your personal philosophy regarding the outcome of your case match your lawyer’s.</p>
<p>&nbsp;</p>
<ul>
<li><strong>What is the likely outcome in my case?</strong></li>
</ul>
<p>While no lawyer can see into the future, we can offer you an informed, honest evaluation of your case, complaint or action – and the results we believe you may be in store for.</p>
<ul>
<li><strong>What are your attorney fees and costs, and how are they billed? Will a portion or all of my case be handled by paralegals or legal assistants?</strong></li>
</ul>
<p>It’s important that you clearly understand the terms of how – and how much – you’ll be billed. Don’t be shy about this topic. It’s okay to ask for clarification if you don’t completely comprehend the billing procedures and payment expectations.</p>
<p>The answers to these questions should go a long way toward helping you determine if the lawyer you’re consulting with is the right person to help you in this situation. I’d encourage you to ask me these and any other questions you’d like anytime you feel like you need legal advice.</p>
